using these certain samples, and avoiding legal problems.

Hey guys,

So i really need some input on some legal things regarding patent law, using samples and naming a current track that i plan on releasing.

about a year ago i started a track using Vengeance samples from the Dirty Electro Vol.1 Sample pack, along with some synths that I made. When I had first "finished" this track I named it as an original mix, and posted it to my soundcloud.

a few days went by and i had someone point out that the song sounded very familiar to them. and not too far after that this person mentioned that it sounded very much like "Leaving Earth" by Stoneface & Terminal. (youtube link below)

and sure enough, i compared the two and they sound very very close, although im not sure about the exact chord progression.

Ive always loved the way my track came out, and was dissapointed to hear that the vengeance samples i used were made to sound like "leaving Earth" I've heard very familiar sounds from other sample kits that sound very much like Mord Fustang, and other popularn artists.

I understand that these samples are Royaly free, and i have the right to use them in my music. I just want to know if it is

okay for me to label this track as a "Leaving Earth" remix. I know that the notes/progression might not be exact, but its close

enough to be labeled as a remix right?

Anyways, i hope my question makes sense and would love some advice!

To be honest, its royalty free, if the notes and everything are different but the sounds are the same because you use the same sample pack they cant blame you for that.

See, thats what i was thinking. But the notes are just so close to the original. Listen to them both (clip below) and let me know what you think?

Its not that stoneface & terminal used the same sample packs, the sample pack were made, or "inspired" by the track Leaving earth by Stoneface & terminal. This is true with other producers like Mord fustang, an lazy rich i believe.

Here is a clip from my track. this is the only part where i used the sample loop as a whole, i just did some fun effects and filter automations.

I really like the melody as it is, and would prefer to name the track as a Leaving Earth Remix. I just want to make sure that Its legal. am i making a big deal out of nothing? or should i scrap the track? lol

See the thing about sample is that you gotta make it your own.

Take a song for example an artist usually play an instrument at 8-16 bars, then you gotta chop up dat shit, And make it your own.

Sampling started a whole new era, RZA and the Wu-Tang Clan are living proof of that (Every beat he makes got a sample in it, still RZA produces in masterclass, you can't find tighter beats than RZA's.

Still gotta pay for it tho, unless it's not classical music, Copyright has a limit ;)

Don't label it the Leaving Earth remix. Then you'll be farked, and get sued, and lose your tune.

Try changing the chord progression a little or adding something or replacing something to keep your original tune intact but differentiate it enough from Leaving Earth.

The publishers for Leaving Earth can't copyright the Vengeance sample just because they are in their tune. They can copyright the other elements but if the chord progression has come from Vengeance it belongs to the owner of the Vengeance sample pack, in this case both you and Stoneface and Terminals publishers (I say their publishers because this is who they would have signed the rights for their tune to).
